High Court restores Non-Party Caretaker Government System

The High Court has reinstated the provision for non-party caretaker governments in the country. Additionally, the court has revived the provision requiring referendums for any constitutional amendments.
A bench comprising Justice Farah Mahbub and Justice Debasish Roy Chowdhury partially annulled the 15th amendment to the constitution. The decision came in response to two petitions challenging the legality of the amendment, which had abolished the caretaker government system.
On December 5, the bench scheduled today for the announcement of its verdict after concluding 12 days of hearings.
On October 19, the HC bench led by Justice Farah Mahbub issued a rule asking the government to explain why the 15th amendment should not be declared unconstitutional. Earlier, on August 19, another bench headed by Justice Naima Haider, currently on leave, had issued a similar rule on the matter.
The case drew arguments from several political parties, including BNP and Jamaat-e-Islami, along with Supreme Court lawyers, who supported the restoration of the caretaker government system.
