The hearing on the appeal for bail of four convicts sentenced to life imprisonment in the murder case of school teacher Mujibur Rahman and his brother Mizanur Rahman in Bheramara upazila of Kushtia in 2016 has come to end. Now the Appellate Division will issue an order on June 20 (Sunday).
A bench headed by Chief Justice Syed Mahmud Hossain passed the order on Thursday.
According to the details of the case, on April 25, 2016, some youth stalkers of Fakirabad area of Bheramara stalked a 8th grader, daughter of Ashrafuzzaman Ratan’s 8th of the same area.
After the incident, the relatives of Ashrafuzzaman Ratan caught the scoundrels in a local market and beat them up.
To take revenge, the stalkers, their family and relatives of the neighbouring Golapnagar village attacked the girl’s grandfather Mujibur Rahman and Mujibur Rahman’s brother Mizanur Rahma while they were returning from the local mosque after prayer. Mujibur Rahman was killed on the spot by a sharp weapon. Mizanur later died at hospital.
Jaharul Islam, son of slain school teacher Mujibur Rahman, filed a case with Bheramara police station. The police filed a chargesheet in the case on May 9, 2016.
Following the trial, the verdict was announced on December 1, 2019. Kushtia Women and Children Repression Tribunal Judge Munshi Moshiar Rahman sentenced 4 accused to death and 7 to life imprisonment.
The convicts with death are Kamal Hossain Malitha of Golapnagar village in Bheramara upazila of Kushtia, Kamrul Pramanik and Sumon Pramanik of Fakirabad village and Nayan Sheikh of the same village.
The convicts sentenced to life imprisonment are Nazrul Sheikh and Abdur Rahim alias Lalim Sheikh of Fakirabad village in Bheramara upazila, Mahfuzur Rahman of the same village, Hridoy Ali, Samrat Ali Pramanik, Ziarul Islam and Ashraf Malitha of Golapnagar village.
The court also sentenced Arif Malitha to 10 years in prison.
Later the Death Reference sent to the High Court. Besides, the accused appealed. Nazrul Sheikh and Abdur Rahim alias Lalim Sheikh, who were sentenced to life imprisonment, Ziarul Islam and Ashraf Malitha of Golapnagar village also applied for bail.
The High Court granted bail to the four on September 24 last year while the appeal was pending.
When the prosecution appealed against the bail, the chamber judge stayed the bail.
At the end of the hearing, the Appellate Division asked the High Court to dispose of the appeal while upholding the order of the Chamber Court.
Four accused appealed against the order of the Appellate Division.
The hearing of this appeal ended on Thursday.
Former Supreme Court Bar President Khandaker Mahbub Hassan appeared for the four accused in the court. On the other hand, Additional Attorney General Sheikh Mohammad Morshed represented the state.
